The No Surprises Act

The No Surprises Act of 2020 (NSA) was a major milestone for healthcare consumers. It restricts the practice of surprise balance billing by out-of-network providers. The NSA requires insurers to keep online information on their networks current. It also provides insured patients with the right to know what benefits are covered by their insurer before scheduled procedures. Uninsured patients now have a right to good faith estimates of costs in advance of these scheduled procedures. It also creates a dispute resolution process if no mutually-agreeable payment can be negotiated, leaving insured consumers out of the price-negotiation process. CMS recently released new data on the NSA’s implementation. According to THCC’s partners at Families USA, more than 80% of all disputes occur in Texas; Florida; Arizona; New Jersey; Tennessee; New York; Georgia; Virginia and Indiana. Since Tennessee is one of the states where high numbers of surprise medical bills are still being sent, THCC is collecting stories of people who have received them.
